Assembly Bill 378

California Assembly Members Christine Garcia, Eduardo Garcia, and Chris Holden have introduced AB 378 which relates to California carbon pricing and criteria pollutants.

The bill includes:

  • A requirement for the Air Resources Board (ARB) to take into account the social cost of carbon in their policies and to prioritize direct emission reductions.
  • Requires that no individual facility be allowed to increase it’s greenhouse gas emissions beyond the average of 2014-2016 levels.
  • Allows the ARB to “adopt no-trade zones or facility-specific declining greenhouse gas emissions limits where facilities’ emissions contribute to a cumulative pollution burden that creates a significant health impact.”
  • Requires the ARB to adopt pollution emission standards for each industrial facility, and then prohibit allocation of allowances to any facility not meeting those standards.
